What to Do in a Legal Malpractice Case

Legal malpractice cases can be very complex and hard fought. After handling hundreds of these cases, I know well what works and what doesn?t. If you are thinking about suing an attorney, be sure to do the following.

Follow All the Rules

Legal malpractice cases have special rules and deadlines. For example, an Affidavit of Merit from a qualified expert is required within 60 days of the Answer to the Complaint. If the 60 days is missed or the form of Affidavit is not followed, the case will most likely be dismissed, with no chance of ever getting to a jury. These kinds of rules might seem arbitrary or bureaucratic, but they are necessary to follow if you want to want to win.

Find Someone You Can Trust

After what you?ve been through you probably don?t trust anyone in the legal system, lawyers, judges, even juries. Ironically, the one person you can trust, and who will also know how to help you recover is a lawyer. Legal malpractice attorneys like me are not always popular among other attorneys. After all, we make a living holding them accountable for their mistakes.
